These Terms of Use explain the contractual agreement between you, who uses this web site and agrees to these Terms of Use ("you", "your"), and Equitable Gas Company, LLC ("Equitable", "we", "us", "our") regarding your use of this web site ("Equitable Gas Web Site") and activities and purchases conducted through the Equitable Gas Web Site.     These Terms of Use are in force until terminated by either you or us. You may terminate these Terms of Use solely by discontinuing your use and access to the site. We may terminate these Terms of Use, or suspend your access to all or part of the Equitable Gas Web Site, without notice, for any conduct that we, in our sole discretion, believe is disruptive to the site or is in violation of any applicable law or these Terms of Use. In the event of termination or expiration of these Terms of Use for any reason, the provisions of Sections 5, 6, 7, 8, 12, 13, 14, 15, 16 and 17 shall survive.

    This site is controlled and operated by us from our offices within the Commonwealth of Pennsylvania, United States of America. Although it may be technically accessed from all 50 states as well as from other countries around the world, you agree that your use of the Equitable Gas Web Site shall be construed to be made from within the Commonwealth of Pennsylvania and you agree that these Terms of Use and your use of the Equitable Gas Web Site shall be governed in all respects by the internal substantive laws of the Commonwealth of Pennsylvania, without regard to conflict of laws provisions. These Terms of Use are an agreement between you and us and are not intended to be for the benefit of any third party. If any provision of these Terms of Use is held to be invalid or unenforceable, such provision will be struck and the remaining provisions enforced. Headings are for reference purposes only. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. Terms of Use for Equitable Gas Online

These additional Equitable Gas Online Terms of Use apply to your use of our Equitable Gas Online web site("Equitable Gas Online ") and the services provided through the Equitable Gas Online and one-time ACH payment sections of this website,, including but not limited to all available methods of electronic bill presentment and payment. These Equitable Gas Online Terms of Use may change from time to time as provided in Section 4 of the Terms of Use. Access to this service is restricted to those persons who have a valid user ID and password (as selected or assigned through the registration process) and who have accepted these Equitable Gas Online Terms of Use. Access or attempted access by unauthorized individuals may be subject to prosecution. Any use of the service is at the sole risk of the user.

  1. Your Responsibility
    You are responsible for all bill payments you authorize using the service. If you permit other persons, or other entities, to use the service by providing your login information, you are responsible for any transactions they authorize from your stored payment accounts. You should notify us immediately if you believe any of your accounts have been accessed or your login information has been taken or used without your permission.
  2. Our Responsibility
    We, or third parties acting on our behalf, are responsible for using commercially reasonable efforts to complete payments on time and according to your properly entered and transmitted instruction. Neither we, nor any of our third party service provides will be liable:
    • If you do not have adequate money in a deposit account or sufficient available credit on a credit card to complete the transaction from the specified account, or if that account has been closed;
    • If you have not properly followed service instructions on how to make a payment;
    • If you have not given complete, correct and current instructions so that a payment can be made;
    • If you do not authorize a payment soon enough for your payment to be made and properly credited by the time it is due;
    • If we or our third party service providers reasonably believe that a transaction may be unauthorized and based thereon the transaction is not completed;
    • If your equipment and/or the software were not working properly and this problem should have been apparent to you when you attempted to authorize a bill payment;
    • if circumstances beyond our or our third party service providers' control prevent making a payment, despite reasonable precautions that we have taken. Such circumstances include but are not limited to computer failure, telecommunication outages, strikes and other labor unrest, delays caused by fires, floods, and other natural disasters.
  3. Login Information
    During your enrollment for this service, you are required to select or will be assigned a user ID and password. Use of this login information is the agreed security procedure to access the service. You agree to keep this information confidential to prevent unauthorized access to your accounts and to prevent unauthorized use of the service. We reserve the right to block access to the service to maintain or restore security to our site and systems, if we reasonably believe your login information has been or may be obtained or is being used or may be used by any unauthorized person(s).
  4. E-Mail
    A valid e-mail address is required to use the service. It is your responsibility to ensure we have a valid e-mail address at all times. You can update your e-mail address on the Internet after logging in to the service.

    You can use electronic mail (e-mail) to contact us about inquiries, maintenance and/or problem resolution issues. E-Mail is not a secure method of communication over the Internet and we recommend you do not send confidential information by e-mail.
  5. Fees
    You may be charged a fee from our third party service providers for making payments through this service. All applicable fees will be displayed on the payment confirmation screen. The fee will be deducted from your bank account or charged to your credit card as part of the total payment amount. This fee is in addition to any fee that your bank or credit card provider may assess. In addition, you may be charged a fee for any payments that are returned due to insufficient funds or any other reason. We reserve the right to collect such fees in any manner deemed appropriate.
  6. Errors and Unauthorized Transactions
    If you believe that an unauthorized transaction has been or may be conducted to or from one of your accounts without your permission:

    In case of errors or questions about any transaction made through this service, contact us immediately. To report an error you must provide us with the following information:
    • Tell us your name and account number(s)
    • Describe the suspected error or the nature of the problem, or describe what information you need.
    • Tell us the dollar amount of the suspected error. If you tell us orally, we may require that you send us your complaint or question in writing. We will use commercially reasonable efforts to tell you the results of our investigation and/or to take steps to correct any error promptly.
  7. Business Days
    Our business days are Monday through Friday except Federal bank holidays.
  8. Business Hours
    Although bill payment transactions will only be processed on business days, we use commercially reasonable efforts to maintain access to these services 24 hours a day, seven days a week, except during any scheduled maintenance periods. Business days for payment transactions are defined as Monday through Friday, 12:00 a.m. to 4:00 p.m. Eastern Time, except Federal bank holidays. Transactions may not be processed until the following business day.
  9. Changes/Interruptions in Service
    We may on a regular basis perform maintenance on our equipment or system, which may result in interrupted service or delays in the updating of data. We also may need to change the scope of our service from time to time. We will attempt to provide prior notice of such interruptions and changes but cannot guarantee that such notice will be provided.
  10. Disclosure of Account Information
    As noted in our Privacy Policy, financial information that is collected from our users may be used to check a users' qualifications for registration and bill the user for products and services. We will not sell your financial information to third parties. This web site also supplements the information that you provide with information that is received from third parties.
    In connection with your use of Equitable Gas Online, we may disclose information to third parties about your accounts if:
    • We have entered into an agreement to have another party provide the payment service or receive your account information. Under agreement from you, the customer, we will provide the third party with information about your stored payment accounts, your service transactions, and your electronic mail messages in order to carry out your instructions;
    • It is necessary for completing payments;
    • It is necessary to verify the existence and condition of a billing account or payment account;
    • In order to comply with laws, government agency rules or orders, court orders, subpoenas or other legal process or in order to give information to any government agency or official having legal authority to request such information;
    • If you otherwise give us your written permission
  11. Electronic Bill Notification
    This service allows you to receive a notification when your monthly bill statement is ready to review. Each month you will receive an e-mail, sent to the e-mail address you provided during registration, telling you when your bill is ready to review. You will be able to log in to your online account and view and print your monthly bill statement. Pennsylvania customers will receive one more bill by mail before paper bills are discontinued. West Virginia and Kentucky customers will continue to receive paper bills.
  12. SNAP (Simple No-fuss Automatic Payment)
    SNAP is Equitable Gas's Simple No-fuss Automatic Payment (SNAP) system. This method is for regular, recurring payments that will be deducted from your checking or savings account every month. If you choose to enroll in SNAP via Equitable Gas Online, you will continue to receive your regular monthly gas bill (either by mail or via Electronic Bill Notification if you have signed up for that service), showing the amount due and due date. SNAP will deduct the amount of your bill from your checking or savings account (as designated by you during SNAP enrollment), paying your bill automatically on the due date.

    A record of your payment will appear on both your next gas bill and your monthly bank statement. A message at the top of your bill, or in your online account monthly bill statement, will notify you when SNAP has been initiated and "SNAP" will be placed in the Amount Paid box of your payment coupon. Please allow at least 30 days for processing following enrollment in SNAP. Additional terms applicable to SNAP, if any, will be presented during the SNAP enrollment process. Should you enroll in SNAP, you authorize us and the financial institution designated to make automatic SNAP payments from the financial account you have specified in the enrollment process. You understand that this authority is to remain in effect until cancelled via the cancellation process outline in Equitable Gas Online.
  13. Additional Terms and Conditions
    We may provide links to third party sites or to embedded functionality provided by third parties, which are subject to additional terms and conditions and/or additional privacy policies/privacy statements of such third parties, and we are not responsible for the privacy practices or the contents of such sites or embedded functionality.
